The National and State Assembly Election Petitions Tribunal in Enugu has nullified the victory of Peoples Democratic Party (PDP) candidate Okey Mbah in the House of Assembly election for the Nkanu East state constituency on March 18.
The Independent National Electoral Commission (INEC) had declared Mbah the election winner, but on Friday, September 29, the tribunal ruled that the process did not comply with the Electoral Act of 2022.
After ruling on the petition filed by Okwudiri Nnaji of the Labour Party, the three-member panel headed by the Honorable Justice Adie Attoe Onyebueke ordered a re-vote in a number of polling stations in the Ugbawka and Owo constituencies.

The tribunal asserted that the number of returned ballots from the two constituencies exceeds the number of registered and accredited voters in those areas, and it criticized INEC’s return.
However, the court ordered the election official to re-vote in the affected polling places within 90 days.
